PART I: PARTNER APP TERMS & CONDITIONS
1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Partner," "you," or "your") and 【Please fill in: Company Legal Name】 ("Kaamio," "we," "us," or "our"), governing your access to and use of the Kaamio Partner mobile application and all associated services. By downloading, installing, registering for, or using the Kaamio Partner App, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund and Cancellation Policy. If you do not agree with any provision, you must not use the App.
2. Eligibility and Age Requirement
You must be at least eighteen (18) years of age to register as a Partner on the Kaamio Platform. By registering, you represent and warrant that you are at least 18 years old and possess the legal capacity to enter into these Terms. You further represent that you have the necessary skills, qualifications, and experience (where applicable) to perform the service categories you have selected. Kaamio reserves the right to verify your age and qualifications and to reject your registration or terminate your account if you do not meet the eligibility criteria.
3. Partner Registration and KYC Verification
To register as a Partner on the Kaamio Platform, you must complete the onboarding process: submit personal details, government-issued photo identification (Aadhaar, PAN, Voter ID, or Driving Licence), live selfie, bank account details/UPI ID, and pay the onboarding fee.
KYC VERIFICATION AND CRIMINAL RESPONSIBILITY: Submission of forged, fake, or falsified identification documents constitutes a criminal offense under the Indian Penal Code, 1860 (including but not limited to Sections 420, 467, 468, and 471) and the Aadhaar Act, 2016. Kaamio will report such offenses to appropriate law enforcement authorities. Any misrepresentation will result in immediate termination, forfeiture of earnings, and legal action.
4. Partner Obligations and Conduct
As a Partner, you agree to: perform services with due skill and diligence; arrive within estimated times; carry appropriate tools; treat Customers with respect; not solicit or accept payments directly from Customers outside the Platform; comply with all applicable laws; keep Customer data confidential; and immediately report safety incidents.
5. Service Standards and Quality
You agree to maintain high standards of service quality. Customers may rate your services and provide feedback. Kaamio reserves the right to remove Partners with consistently low ratings (below the threshold specified on the Platform), impose quality improvement requirements, or suspend/terminate accounts.
6. Commission and Payment Structure
Kaamio charges a commission on each completed transaction. The commission rate varies by service category and is displayed in your dashboard. The remaining balance after commission deduction is remitted to your bank account or UPI ID (typically 3-5 business days). Onboarding fees are charged at registration. Kaamio reserves the right to modify commission rates with 30 days' notice.
7. GST and Tax Responsibility
IMPORTANT TAX NOTICE: YOU ARE SOLELY RESPONSIBLE FOR ALL TAX OBLIGATIONS ARISING FROM YOUR EARNINGS ON THE KAAMIO PLATFORM.
Kaamio is a technology intermediary and is not your employer. You are responsible under the Income Tax Act, 1961 and the GST Act, 2017. If your annual turnover exceeds the threshold (currently INR 20 lakhs, or INR 10 lakhs for special states), you must register for and charge GST. Kaamio will deduct TDS under Section 194-O of the Income Tax Act only as legally required. You agree to indemnify Kaamio against tax-related claims.
8. Fraud, Chargeback, and Payout Withholding
Kaamio maintains a zero-tolerance policy towards fraud.
- Fraud Investigation: Kaamio may investigate bookings or activities suspected of being fraudulent.
- Payout Withholding: Kaamio reserves the right to withhold/freeze payouts during an active investigation. Fraudulent earnings may be permanently forfeited.
- Chargeback Handling: Disputed Customer transactions may be provisionally deducted from Partner earnings.
- Consequences of Fraud: Termination, reporting to authorities, and permanent blacklisting.
9. Safety Compliance for Home Services
As a Partner providing services at Customers' premises: you must conduct yourself professionally; not engage in theft, harassment, or criminal behavior; report safety hazards immediately; and avoid arriving under the influence of alcohol or drugs. Criminal behavior will be reported to law enforcement.
10. Insurance Disclaimer
KAAMIO DOES NOT PROVIDE ANY INSURANCE COVERAGE TO PARTNERS. You are solely responsible for obtaining professional liability, general liability, workers' compensation (if employing assistants), health, and accident insurance.
11. Intellectual Property
You license Kaamio to use your profile photograph, portfolio, and descriptions for marketing/operations. The intellectual property of the App remains with Kaamio.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAAMIO SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. KAAMIO DOES NOT GUARANTEE MINIMUM EARNINGS OR UNINTERRUPTED AVAILABILITY. TOTAL AGGREGATE LIABILITY IS CAPPED AT INR 10,000 OR THE COMMISSION RETAINED IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify Kaamio against all third-party claims, losses, or liabilities (including legal fees) arising from your services, violation of these Terms, negligence, or tax non-compliance.
14. Termination
Kaamio may suspend/terminate your Partner account at any time. Fraud, safety violations, criminal behavior, or fake KYC results in immediate termination and withholding of pending payouts up to 30 days.
15. Dispute Resolution
Any dispute shall be resolved via the progressive mechanism: informal resolution within 30 days, mediation within 60 days, and binding arbitration under the Arbitration and Conciliation Act, 1996 in New Delhi (venue/seat). The Consumer Protection Act, 2019 exception does not apply to Partners as commercial entities.
PART II: GENERAL PROVISIONS
1. Governing Law and Jurisdiction
These Terms and Conditions, Privacy Policy, Refund and Cancellation Policy, and all other legal documents contained herein shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The courts at 【Please fill in: Jurisdiction City, e.g., New Delhi】 shall have exclusive jurisdiction over any legal proceedings arising out of or in connection with these documents.
2. Dispute Resolution and Arbitration
Kaamio is committed to resolving disputes efficiently and fairly. The following comprehensive dispute resolution framework applies to all disputes:
- Tier 1 - Support Support: Any user with a dispute must first contact Kaamio's support team at 【Please fill in: Support Email Address, e.g., support@kaamio.in】. Kaamio will attempt to resolve it within thirty (30) calendar days.
- Tier 2 - Mediation: If unresolved, either party may initiate mediation facilitated by a mediator from the 【Please fill in: Mediation Body, e.g., Delhi Dispute Resolution Society】 or another mutually agreed-upon mediator.
- Tier 3 - Arbitration: Any dispute not resolved through mediation shall be referred to and finally resolved by binding arbitration administered under the Arbitration and Conciliation Act, 1996 by a sole arbitrator. 3. Severability
If any provision of these legal documents is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitral tribunal, such invalidity, illegality, or unenforceability shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
4. Waiver
The failure of Kaamio to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by Kaamio.
5. Entire Agreement
These Terms and Conditions, together with the Privacy Policy, Refund and Cancellation Policy, and any other policies or agreements incorporated by reference, constitute the entire agreement between you and Kaamio regarding the use of the Platform.
6. Amendments
Kaamio reserves the right to amend these Terms at any time by posting the revised Terms on the Platform and notifying you. Material changes will be notified at least fifteen (15) days before they take effect. For Partners, changes to commission rates or onboarding fees shall be notified thirty (30) days in advance.
7. Notices
All notices required or permitted under these Terms shall be in writing and shall be deemed delivered: (a) when sent by email; (b) when sent through the App's notification system; (c) when sent by registered post. 8. Assignment
You may not assign, transfer, or delegate these Terms or your rights or obligations hereunder, in whole or in part, without Kaamio's prior written consent. Kaamio may assign its rights and obligations under these Terms without your consent.
9. Force Majeure
Kaamio shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond Kaamio's reasonable control, including but not limited to: acts of God, natural disasters, epidemics, war, internet failures, or power outages.
