1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and 【Please fill in: Company Legal Name】 ("Kaamio," "we," "us," or "our"), governing your access to and use of the Kaamio mobile application and all associated services (collectively, the "Service"). By downloading, installing, registering for, or using the Kaamio App, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund and Cancellation Policy, all of which are incorporated herein by reference. If you do not agree with any provision of these Terms, you must not use the App.

2. Eligibility and Age Requirement

You must be at least eighteen (18) years of age to register for and use the Kaamio App. By registering an account, you represent and warrant that you are at least 18 years old and possess the legal capacity to enter into these Terms. If you are accessing the Service on behalf of a business entity, you further represent and warrant that you have the authority to bind that entity to these Terms. Kaamio reserves the right to verify your age through government-issued identification or other means, and to suspend or terminate your account if it is determined that you are under 18 years of age. Accounts belonging to minors will be terminated immediately and all associated data will be deleted in accordance with our Privacy Policy.

3. Account Registration

To use the Service, you must register an account by providing accurate, complete, and current information, including your full name, mobile phone number, and email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify Kaamio immediately of any unauthorized use of your account. Kaamio shall not be liable for any loss or damage arising from your failure to maintain the security of your account. You may not create multiple accounts, transfer your account to another person, or use another person's account without authorization.

4. Service Description, Availability, and Disclaimers

Kaamio is a technology platform that connects Customers with independent third-party service providers ("Partners") for hyperlocal home services including but not limited to plumbing, electrical work, cleaning, painting, appliance repair, beauty services, and other categories as may be offered from time to time. Kaamio acts solely as an intermediary facilitator and does not itself provide any home services. The Partners are independent contractors and are not employees, agents, or representatives of Kaamio.

NO SERVICE LEVEL AGREEMENT (SLA) OR GUARANTEE: KAAMIO PROVIDES THE PLATFORM AND SERVICE ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR GUARANTEES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, KAAMIO EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

5. Booking and Service Requests

You may browse available service categories and Partners, and submit a service request through the App. Upon submitting a service request, the request is broadcast to available Partners in your area. Kaamio does not guarantee that any Partner will accept your request. Once a Partner accepts your request, you will receive confirmation and the Partner's profile details. You acknowledge that the actual service delivery is entirely between you and the Partner, and Kaamio's role is limited to facilitating the connection, processing payments, and providing dispute resolution support. You agree to provide accurate information regarding the service required, the service location, and access instructions. Any misrepresentation may result in cancellation charges or account suspension.

6. Payment Terms

Payment for services booked through the Platform is processed via our integrated payment gateway (currently Razorpay). You agree to pay the full amount displayed at the time of booking confirmation, which may include the service charge, applicable taxes (including GST), and any convenience fees. Prices displayed on the Platform are subject to change without prior notice, though the price confirmed at the time of booking shall be binding. Kaamio reserves the right to apply surge pricing during periods of high demand, which will be clearly communicated before you confirm your booking. All payments are non-refundable except as provided in our Refund and Cancellation Policy.

7. Cancellation and Refund

Cancellations and refunds are governed by the Refund and Cancellation Policy (Part IV of this document), which is incorporated herein by reference. By agreeing to these Terms, you acknowledge that you have read and understood the Refund and Cancellation Policy. Cancellation fees may apply depending on the timing of the cancellation relative to the scheduled service.

8. Customer Conduct and Responsibilities

You agree to use the Platform in compliance with all applicable laws and regulations and in a manner that does not infringe the rights of others. Specifically, you shall not: provide false, misleading, or incomplete information; harass or abuse any Partner; request engagement for illegal purposes; circumvent the Platform's payment system; or attempt to reverse engineer the App.

10. Insurance Disclaimer

KAAMIO DOES NOT PROVIDE ANY INSURANCE COVERAGE TO CUSTOMERS OR PARTNERS. Neither Kaamio nor its affiliates, directors, officers, employees, or agents carry or provide any form of insurance covering property damage, personal injury, theft, or any other liability arising from services. Customers are strongly advised to verify their existing homeowner's or renter's insurance.

11. Intellectual Property

All intellectual property rights in the Platform, including the App, its design, graphics, user interface, code, trademarks, logos, and content, are owned by or licensed to Kaamio. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purposes.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAAMIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. IN NO EVENT SHALL KAAMIO'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF: (i) THE TOTAL AMOUNT YOU PAID TO KAAMIO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (ii) INR 10,000.

13. Indemnification

You agree to indemnify, defend, and hold harmless Kaamio, its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, violation of these Terms, or any wrongful act or omission on your part.

14. Termination

Kaamio reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease.

15. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved through the progressive dispute resolution mechanism: Step 1 (Informal Resolution within 30 days), Step 2 (Mediation within 60 days), and Step 3 (Binding Arbitration). Consumer Forums under the Consumer Protection Act, 2019 are excepted where mandatory by law.

1. Governing Law and Jurisdiction

These Terms and Conditions, Privacy Policy, Refund and Cancellation Policy, and all other legal documents contained herein shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The courts at 【Please fill in: Jurisdiction City, e.g., New Delhi】 shall have exclusive jurisdiction over any legal proceedings arising out of or in connection with these documents.

2. Dispute Resolution and Arbitration

Kaamio is committed to resolving disputes efficiently and fairly. The following comprehensive dispute resolution framework applies to all disputes:

• Tier 1 - Customer Support: Any user with a dispute must first contact Kaamio's support team at 【Please fill in: Support Email Address, e.g., support@kaamio.in】. Kaamio will attempt to resolve it within thirty (30) calendar days.
• Tier 2 - Mediation: If unresolved, either party may initiate mediation facilitated by a mediator from the 【Please fill in: Mediation Body, e.g., Delhi Dispute Resolution Society】 or another mutually agreed-upon mediator.
• Tier 3 - Arbitration: Any dispute not resolved through mediation shall be referred to and finally resolved by binding arbitration administered under the Arbitration and Conciliation Act, 1996 by a sole arbitrator. 3. Severability

If any provision of these legal documents is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitral tribunal, such invalidity, illegality, or unenforceability shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

4. Waiver

The failure of Kaamio to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by Kaamio.

5. Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Refund and Cancellation Policy, and any other policies or agreements incorporated by reference, constitute the entire agreement between you and Kaamio regarding the use of the Platform.

6. Amendments

Kaamio reserves the right to amend these Terms at any time by posting the revised Terms on the Platform and notifying you. Material changes will be notified at least fifteen (15) days before they take effect.

7. Notices

All notices required or permitted under these Terms shall be in writing and shall be deemed delivered: (a) when sent by email; (b) when sent through the App's notification system; (c) when sent by registered post. 8. Assignment

You may not assign, transfer, or delegate these Terms or your rights or obligations hereunder, in whole or in part, without Kaamio's prior written consent. Kaamio may assign its rights and obligations under these Terms without your consent.

9. Force Majeure

Kaamio shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond Kaamio's reasonable control, including but not limited to: acts of God, natural disasters, epidemics, war, internet failures, or power outages.
